A. Not Financial, Investment, or Trading Advice: WickScribe is strictly a local data-entry, journaling, and visualization utility. Nothing contained in or generated by the software—including Behavioral Expected Value (EV) calculations, MFE/MAE statistics, Prop Firm drawdown trackers, or third-party AI Analyst outputs—constitutes financial, investment, legal, tax, or trading advice. All trading decisions are made solely at your own risk.
B. Provided Strictly "AS-IS" Without Warranty: THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF MATHEMATICAL CALCULATIONS, OR NONINFRINGEMENT. You assume the entire risk as to the quality, accuracy, and performance of the software.
C. Free Trial & No Guarantee of Future Updates: Your purchase grants you a lifetime license to the WickScribe desktop executable as delivered, preceded by an optional 14-day free trial. While updates may be released periodically, the developer makes no promise, warranty, or binding commitment to provide future software updates, bug fixes, patches, new features, or ongoing technical support.
D. Limitation of Liability & Prop Firm Disclaimers: In no event shall the creator, developer, or distributor of WickScribe be liable for any direct, indirect, incidental, special, exemplary, or consequential damages—including, without limitation, trading losses, lost profits, breached proprietary trading firm evaluations or funded accounts, inaccurate commission or drawdown calculations, or corrupted local data—arising out of the use or inability to use the software. Always verify your official account balances, commissions, and drawdown limits directly on your broker or prop firm's official platform.
E. Third-Party APIs, AI Outputs & Broker Formats: WickScribe relies on user-supplied API keys (Databento, OpenAI, Google Gemini, Anthropic) and third-party broker CSV formats. The developer has no control over, and assumes no liability for, changes to third-party APIs, API downtime, billing charges incurred on your API keys, inaccurate or "hallucinated" AI outputs, or future changes to broker CSV export structures.
2. Risk Disclosure & Local-First Privacy Policy
A. Substantial Risk of Futures & Derivatives Trading (CFTC Rule 4.41): Trading futures, options, equities, and derivatives involves substantial risk of loss and is not suitable for all investors. You may lose more than your initial investment. Past performance, historical chart replays, and simulated or statistical Expected Value (EV) metrics shown in the software are not necessarily indicative of future results.
B. 100% Local Data Storage & User Backup Responsibility: WickScribe stores all trade logs, custom playbook tags, journal notes, and pasted screenshots locally on your device inside your operating system's AppData directory (sqlite:trades.db). Because we operate no cloud servers and cannot access or recover your files, you are solely responsible for maintaining regular local backups of your data using the built-in Backup (JSON) and Export (CSV) utilities in Settings.
C. OS Keychain Security & Zero Telemetry: WickScribe collects zero telemetry, usage analytics, or personal data. Third-party API keys entered in Settings are stored locally in your operating system's credential vault (macOS Keychain or Windows Credential Manager).
D. Outbound Network Transmissions (BYOK): Outbound network requests occur only when triggered by you: (1) Market replay requests send only the contract symbol, timeframe, and timestamps to hist.databento.com; (2) Clicking ⚡ AI Audit or ⚡ Generate Report sends only the selected trade metrics, playbook/emotion tags, and typed trade reflections to your configured AI endpoint (OpenAI, Gemini, Anthropic, or local Ollama). Total account balances and raw SQLite database files are never transmitted.
E. Merchant of Record & Checkout Privacy: All payments, tax compliance, and digital installer deliveries are processed by our Merchant of Record, Dodo Payments, in accordance with their privacy policy and terms of service.
